The law

What the new law changes

Legislative Decree 209/2025, transposing EU Directive 2023/2673, introduces art. 54‑bis of the Italian Consumer Code: for contracts concluded online, consumers must be able to withdraw through a dedicated digital function.

The obligation applies to all distance contracts concluded online with consumers (B2C) and starts on 19 June 2026. It stems from Directive (EU) 2023/2673, transposed in Italy by Legislative Decree 209/2025, and adds to — without replacing — the existing right-of-withdrawal rules of the Italian Consumer Code.

The risks of non‑compliance

Do I need an account to buy?

No. Checkout is handled by Stripe secure payment: just your email and payment details, no sign‑up.

Will I get an invoice?

Yes. We collect billing details at checkout and you’ll get an email confirmation; the invoice is issued by DigiBite.

Can I get a refund?

Yes, you can request a return within 14 days of purchase directly from the site, in a few clicks.

How many sites does a license cover?

Each license covers 1 WooCommerce site with 2 activations: one for production and one for staging. You can move it to another site by deactivating it. For more sites, see the multi‑license options or contact us.

Does the license work in staging too?

Yes. In addition to the production site, the license includes one activation for the staging environment of the same site (chosen at activation). The license is tied to the site URL; automatic updates require an active license and, on expiry, the already‑configured withdrawal form keeps working.

Is the withdrawal button really mandatory? From when?

Yes. From 19 June 2026, art. 54-bis of the Italian Consumer Code (introduced by Legislative Decree 209/2025) requires every B2C eCommerce to provide a digital function to exercise withdrawal online. Recesso Facile adds it to your WooCommerce in a compliant way.

What do I risk if I don’t comply?

A missing function can amount to an unfair commercial practice: AGCM fines range from €7,500 to €75,000 per violation and, in the most serious cases, up to €10 million. Also, with inadequate information, the withdrawal period can extend up to 12 months and 14 days.

Is it compatible with HPOS and my theme?

Yes. The plugin is HPOS compatible and relies on the standard WooCommerce checkout and account area, so it works regardless of your theme or page builder.

Can I customize the button’s text, colors and position?

Yes. You can choose a 1–5 visibility scale, colors, icon, position and the menu where the withdrawal appears, while keeping compliant wording.

Does it work for guest buyers too?

Yes. The form works both for registered users and for guest buyers, with order verification.

Does it apply only to physical products or also to services and digital content?

The obligation covers distance contracts concluded online with consumers. Recesso Facile adds the withdrawal function to your WooCommerce orders; for special cases (e.g. some services or digital content) always check with your advisor.

What’s the difference between withdrawal and returns?

Withdrawal is the consumer’s right to change their mind within 14 days; returns (RMA) is the operational handling of goods coming back. Recesso Facile handles the compliant withdrawal function required by law.
