1. Provider and seller
The site recessofacile.it and the sale of the “Recesso Facile for WooCommerce” software are operated by DigiBite srl, based at Via Valle D’Aosta, 2/L – 41049 Sassuolo (MO), Italy – VAT 03824810364, email store@digibite.it (“DigiBite”, “we”). These Terms & Conditions govern the purchase of the product through this site.
2. Subject of the contract
Recesso Facile is a WordPress/WooCommerce plugin provided under a usage licence. The purchase grants the right to use the plugin according to the chosen plan, together with the updates and support included. The plugin is a technical tool supporting the store’s compliance with the right-of-withdrawal obligations.
3. Plans and pricing
Several plans are available — for example an annual subscription with automatic renewal, a lifetime licence with a single payment, and multi‑licence options for several sites. The available plans, prices, duration and any current promotions are those published on the site and summarised on the checkout screen before you confirm the order.
Unless otherwise stated, prices are in euro and exclude VAT; VAT is added at checkout according to the applicable rate. Price changes and promotions do not affect orders already confirmed: each purchase is governed by the pricing shown and accepted at the time of the order.
4. How to purchase and payment
Purchases are made online, with no account required. Payment is securely handled by Stripe; DigiBite does not store card details. To complete the order you must provide a valid email address and the required billing details.
5. Electronic invoicing
For every purchase DigiBite issues an electronic invoice based on the data provided: tax code for private individuals; company name, VAT number and SDI recipient code or PEC for professionals and companies. The buyer is responsible for providing correct and complete billing data.
6. Delivery and activation
Once payment is complete, the buyer receives an email confirmation with the order reference and instructions to download and activate the plugin on their WooCommerce site.
7. Right of withdrawal and digital content
Pursuant to articles 52 et seq. of Legislative Decree 206/2005 (the “Consumer Code”), the right of withdrawal is granted exclusively to consumers acting for purposes outside their business, commercial, craft or professional activity.
The consumer has the right to withdraw from the contract within 14 days of completing the purchase, without having to give any reason and without incurring costs other than those provided for by law.
However, the “Recesso Facile for WooCommerce” plugin is digital content supplied on a non-tangible medium. Pursuant to art. 59(1)(o) of the Consumer Code, the right of withdrawal is lost where performance of the contract has begun with the consumer’s express consent and with their acknowledgement that they will thereby lose the right of withdrawal.
Before completing the order, the consumer is therefore required to give their express consent to the immediate performance of the contract and to acknowledge the consequent loss of the right of withdrawal once the plugin download, the licence key or any other means of accessing the software has been made available.
Accordingly:
- if the plugin download has not yet been made available and the licence has not been activated, the consumer may exercise the right of withdrawal within 14 days of the purchase;
- once the plugin download has been made available, the licence has been provided or the service has been activated, the right of withdrawal can no longer be exercised.
Purchases made by professionals, companies or VAT-registered persons in the course of their professional or business activity do not benefit from the right of withdrawal provided by the Consumer Code, unless otherwise expressly stated by DigiBite.
Where the right of withdrawal is validly exercised, DigiBite will refund the amounts received using the same payment method used for the original transaction, within 14 days of receiving the request.
The withdrawal request may be submitted using the “Request a return” form available on the site or by sending a message to store@digibite.it, indicating the email used for the purchase and the order reference. DigiBite will send an acknowledgement of receipt of the request stating the date and time of submission.
8. Renewal and cancellation (Annual License)
The Annual License renews automatically each year at the stated renewal amount, unless cancelled. Cancellation can be made at any time and takes effect from the next renewal period; periods already paid are non-refundable, without prejudice to the right of withdrawal under section 7.
9. Licence, activation and environments
The plugin is provided under a usage licence, not sold. Each licence is tied to the site on which it is activated, identified by its exact URL: subdomains and subdirectories are treated as separate sites and, on WordPress multisite, the licence applies to the individual subsite.
Each licence allows two activations for the same site: one in production and one in staging (the environment is chosen at activation). The licence can be transferred to another site by deactivating it on the original site. Local development environments (e.g. localhost, .test or .local domains and IP addresses) may not consume an activation.
Reselling, redistributing or sharing the licence with unauthorised third parties is prohibited. All intellectual property rights in the software remain with DigiBite.
10. Updates and support
For the entire duration of the active licence, plugin updates and email technical support are included. With the lifetime licence, updates are included with no time limit.
Automatic updates are delivered through the licence server and require an active licence. If the licence server is temporarily unreachable, the plugin keeps working in grace mode based on the last valid check. When the licence expires, access to the settings and updates stops, but the already‑configured withdrawal form remains active, as it is a function required by law.
11. Limitation of liability
The plugin is provided “as is”. DigiBite undertakes to keep it updated and functional but does not guarantee suitability for every specific store configuration. Recesso Facile is a technical support tool: responsibility for correctly fulfilling legal obligations remains with the store owner.
12. Data protection
The processing of personal data is described in DigiBite’s Privacy Policy. The site uses Google reCAPTCHA for bot protection: the Google Privacy Policy and Terms of Service apply.
13. Governing law and jurisdiction
These Terms are governed by Italian law. For consumer relationships, the mandatory competent court is that of the consumer’s place of residence or domicile; in other cases the Court of Modena has jurisdiction.
